Terms of Use

1. General Provisions

These Terms of Use ("Terms") govern access to and use of the Kendy platform ("Service"), including the website, API, and all associated services. By registering or using the Service, you accept these Terms in full.

If you do not agree with any provision of these Terms, please do not use the Service.

2. Description of the Service

Kendy is a B2B SaaS platform for automated business lead collection. The Service provides:

• KendyMaps — search for businesses on Google Maps by niche and location
• KendySites — website scanning and collection of contact data
• KendyMind — AI analysis, ICP profile generation, and lead scoring
• KendyReach — automated email campaigns
• KendyDev — custom development of landing pages, Telegram bots, and AI solutions

3. Registration and Account

• To use the Service, you must create an account with accurate information
• You are responsible for maintaining the confidentiality of your login credentials
• One account per person/company — multiple accounts are prohibited
• You agree to immediately notify us of any unauthorized access to your account

4. Acceptable Use

By using the Service, you agree to:

• Use the data solely for legitimate B2B purposes
• Comply with anti-spam legislation when sending email campaigns
• Not use the Service to collect personal data of natural persons
• Not resell or transfer collected data to third parties without consent
• Not attempt to circumvent technical restrictions or plan limits

5. Prohibited Use

The following are strictly prohibited:

• Spam campaigns — mass sending of irrelevant messages
• Phishing and fraud — deceiving recipients
• Collecting data for unlawful purposes — harassment, discrimination
• Reverse engineering — decompiling or copying the Service
• Infringement of rights — actions that violate the rights of third parties

Violation of these rules may result in immediate account suspension without a refund.

6. Payment and Plans

• Current prices are listed on the Pricing & Plans page
• Subscription — monthly payment with automatic renewal
• One-time services — payment in advance before work begins
• Prices may change with 30 days' notice
• Detailed payment terms are set out in the Public Offer Agreement

7. Intellectual Property

All rights to the Service, including the code, design, trademark "Kendy", logo, and content belong to Kendy. You receive a non-exclusive license to use the Service in accordance with your chosen plan. Lead data you collect belongs to you, but you do not acquire any rights to the algorithms, technologies, or infrastructure of the Service.

8. Limitation of Liability

• The Service is provided "as is" without warranties
• We do not guarantee 100% accuracy of collected data
• We are not liable for the results of email campaigns (open rate, conversions)
• Maximum liability is limited to the amount paid by you in the last 3 months
• We are not liable for damages caused by misuse of the Service

9. Termination

• You may delete your account at any time through the settings
• We may suspend your account for violation of these Terms
• Upon account deletion, data is retained for up to 30 days (in accordance with the Privacy Policy)
• Refund terms are described in the Refund Policy

10. Changes to the Terms

We may update these Terms. We notify users of material changes via email or a site banner at least 14 days before the changes take effect. Continued use of the Service after changes have been made constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Ukraine. Disputes shall be resolved through negotiation, and if no agreement is reached, before the courts of Ukraine at the location of Kendy.
